A Citizen’s Perspective On The Harmonised Draft Constitution Of Kenya – Securing Human, Economic, Social and Cultural Rights Are The Only Basis For The Establishment of A State And A Constitution To Govern It.
Kenya is a Sovereign Republic: The Harmonized Draft Constitution has described Kenya as a Sovereign Republic which is founded on Principles of Good Governance through Multi party democracy, participatory governance, transparency and accountability, separation and devolution of powers, respect for human rights and fundamental freedoms and the Rule of Law.
The purpose of establishing a State and a Constitution: To secure the basic human, economic, social and cultural rights is the purpose of establishing a State and a Constitution. The Constitution declares the Rights of the Individuals and groups and makes the state responsible for guaranteeing those rights. These Rights can be found in the Bill of Rights in Chapter 5 of the current Constitution and in Chapter 6 of the harmonised draft Constitution. The Bill of Rights is not merely an integral part of Kenya’s democratic State; it is the fundamental basis for the establishment of the State. In other words, apart from our securing our Rights as Citizens, there is no other purpose or reason to create a State or a Constitution.
Rights are inalienable and possessed by Kenyans: The purpose of the recognition and protection of Human Rights and fundamental freedoms in the Constitution is because these rights are inalienable and possessed by all Kenyans without regard to their social status, origin or persuasion. The State is therefore required by Kenyan citizens to use all State resources and Institutions to enhance these Rights and the State is prohibited from using its resources and Institutions to curtail these Rights as guaranteed to Kenyans. Rather, all resources owned by the State belong to Kenyans and are to be used for the benefit of Kenyan Citizens in protecting their rights.
All Kenyans are born equal: Fundamental Rights and Freedoms of Kenyans Citizens are given by God, and not by the State. Kenyans have Human Rights because Kenyans are human beings. All these rights are recognised by the entire world and restate that all human beings are born equal. Kenyans through their Government have signed and ratified International Human Rights, Civil and political Liberties, social economic and cultural rights conventions and these international laws are applicable in Kenya. Therefore the State does not give these Rights and cannot legally or lawfully take them away. Our Constitution is supposed to restate these Rights and protect them at all times.
All sovereign power in Kenya belongs to the Citizens of Kenya: All sovereign power in Kenya belongs to the Citizens of Kenya. Citizens exercise this power through the Constitution of the Republic of Kenya. The Constitution is the supreme Law of the Republic that binds all State Organs at all levels of Government and all persons. The Citizens of Kenya may exercise their sovereign power either directly or through their democratically elected representatives, but the sovereign power at all times belongs to the Citizens of Kenya. Everything must be for the good of Kenyan Citizens.
When people live or work together, they agree on how they will run their affairs: Kenya is a defined geographical territory under one government and one set of laws, with its own currency, army, national symbols, system of taxation, etc. It is sovereign – that is, it is politically independent from other states and not subject to outside control. The people who live in Kenya are either citizens of Kenya or citizens of other states legally permitted to live and/or work in Kenya. When people live or work together, they need to agree on how they will run their affairs. In a political state, as well as in some organisations, this agreement takes the form of a CONSTITUTION.
The legislature, the executive and the judiciary: The Kenyan governmentis the machinery through which the state operates. It is made up of the legislature, the executive and the judiciary. The legislature makes laws, the executive enforces them and the judiciary interprets and applies them. In a democratic society, the purpose of a lawfully elected government is to carry out the people’s will.
In a democracy, citizens share the job of governing their state: A good description of the meaning of democracy is that given by Abraham Lincoln, the US President who abolished slavery in America, in his famous Gettysburg Address, read at Gettysburg, Pennsylvania on November 19, 1863, during the American Civil War: ‘a government of the people, by the people, for the people.’ This implies that in a democracy, citizens share the job of governing their state. Some citizens serve in institutions set up by the Constitution and other laws under the Constitution. But these citizens are not special – they only have special duties and responsibilities to the rest of their fellow citizens. Most people know democracy as a form of government in which policy is decided by the favourite choice of the majority, usually by elections or referendum, open to its citizens. And the policy is implemented by the citizens who work in State institutions.
The Goals of a Democratic Society: Democracy dictates that the following goals are achieved in a democratic Society:-
* The greatest possible freedom for all;
* A just society;
* The same rules for all;
* Equality before the law;
* Respect for the rule of law; and
* Equal opportunities for all.
Democracy needs open-mindedness and agreement between the citizens: In a democracy, cooperation by Citizens is needed, because elections divide the population into ‘winners’ and ‘losers’. It is implied that whoever loses, allows the winners to take power peacefully and without argument. Democracy needs open-mindedness and agreement between the citizens, especially when one group is bigger than all the others. In a democracy, such a majority should not ignore the wishes and needs of members of smaller groups or minorities. Minorities include not just ethnic groups but disadvantaged and people with disabilities. At all times Citizens must act in the interest of their fellow Citizens, that way Citizens will guarantee their own interests.
Every citizen shares the responsibility for civic awareness: Democracy involves providing opportunities for all citizens without discrimination, and sometimes it also means helping some people – those disadvantaged by history, physical disability, or by factors that they can not control such as natural disasters. Democracy also asks citizens to do certain things or make sure that certain things are done. For example, every citizen shares the responsibility for civic awareness, democratic care, and working together for the good of the country. This very important particularly now that the Harmonised Draft Constitution is now a public document open for public comment.
Democracy provides a base for honesty, fairness and equality: In a democracy, everyone is equal. Democracy turns away any forms of bias and provides a base for honesty, fairness and equality. Justice is a set of rules that provide each person in humanity with basic rights. These include: Human rights, the rule of law, Economic justice, and Gender fairness.
Rule of Law: The idea of the ‘rule of law’ is based on the idea of government by law. This means that no one is above the law; this basically means that all Kenyans are equal before the law and are subject to it. So no one can be punished unless they have broken the law and have been tried through the proper legal process. So, Leaders have to abide by the law. Any Kenyan who makes choices has to make them according to the say so of the law.
All Kenyans are equal before the law and are subject to it: From the President and the Prime Minister and their deputies to the citizen with no public position: Also, the law should apply to everyone equally without any favouritism on the basis of gender, race, ethnicity, religion, political association, colour, disability, social status and other physical or social characteristics.
Economic justice means that Kenyan citizens can get rich legally: Economic justice is the equal sharing, distribution and allocation of socio-economic wealth among all citizens. Economic justice means that Kenyan citizens can get rich legally for the good of the individual and/or for the common good. It requires the state to be fair when allocating public resources for development. Economic justice includes the right to:
* Fair and favourable conditions of work;
* Equal pay for work of equal value;
* The right to form and belong to a trade union;
* The right to go on a strike; and
* The right to enjoy social security.
Citizens give their authority through their elected representatives to be taxed through their income and consumption. The taxes collected by the State are meant to benefit
Fundamental Freedoms and Rights protected by the current Constitution of Kenya:
* The right to life,
* The right to personal freedom,
* Protection against slavery and forced labour,
* Protection from inhuman treatment,
* Protection from property being taken away illegally,
* Protection against illegal search or entry,
* The right to the protection of the law,
* Freedom of conscience,
* Freedom of expression,
* Freedom of association and assembly,
* Freedom of movement, and
* Freedom from discrimination
The Harmonised Draft Constitution restates these rights and adds further categories of rights including political, economic, social and cultural fundamental rights.
Political freedom is the ability to:
* the right to participate in political activity without restriction
* hold your own views and talk about what you think and believe,
* relate and socialize
* Move freely without obstruction.
Economic freedom is:
* the ability to own and use property,
* the chance to work and provide for your living, and
* Freedom from forced labour and slavery.
Social freedom is:
* Treating people fairly,
* Privacy
* No cruel treatment.
These democratic freedoms are found in Chapter 6 “The Bill Of Rights” in the Harmonised Draft Constitution of Kenya.
Nothing in the Constitution can take away any of your Rights: The Bill of Rights is essential reading if citizens wish to understand the Draft Constitution. Nothing in the Constitution can take away any of your Rights. The Constitution creates State Organs and delegates Authority to State organs in order to enhance and protect the Rights of Citizens. Nothing in the Constitution can take Sovereign power away from the Citizens of Kenya. All delegated power is exercised on behalf of the Citizens who elect and choose those who they wish to exercise that power on their behalf.
Constitution is not meant to benefit Politicians at the expense of Citizens: The Constitution is not meant to benefit Politicians at the expense of Citizens. It is therefore important for Citizens to understand the Draft for themselves and not be swayed by Politicians. At the end it is Kenyans who will decide what they want at the referendum. We need a Constitution that will determine how we want to live together as Citizens and how we wish to be governed.
Are we satisfied with what the draft has to say on these views?
Therefore, when reading the Draft, all Citizens must ask the question, “does this provision protect my Rights? Does this provision enhance my Rights?”The test must at all times be whether you the Citizen of Kenya are in charge of your affairs. Has the Draft addressed the views of Kenyans collected by the Constitution of Kenya Review Commission in 2002? Are we satisfied with what the draft has to say on these views? What do you want added or removed from the Draft?

BUDGET 2009/2010 CREATES A SECRET FUND INVOLVING MILLIONS OF US DOLLARS. WHY WAS PARLIAMENT NOT TOLD ABOUT THIS?
BUDGET 2009/2010 SERIES 001
Buried in the Finance Bill that the Minister of Finance, Uhuru Kenyatta tabled in Parliament last week is a proposal to amend two laws in order to create a fund whose purposes are barely specified. The Fund could be worth over 1 and a half billion shillings per annum, yet total discretion will be given to a parastatal corporation board who will decide how this money will be spent, without external oversight. The parastatal corporation which will be the legal owner of the fund is notorious for corruption and the parent ministry of Transport is behind at least some of the Anglo Leasing scams that cost the Treasury dearly since the mid 1990s.
In a clever side-stepping of Parliament, the law is to be changed to allow this parastatal corporation to borrow using its sink fund as collateral, avoiding the need to satisfy investors’ demands that it charge or mortgage its real assets – a practice specifically prohibited by Kenyan law. Why these legal changes are being done is a mystery as the issue did not feature at all in the 3 hour long Budget Day speech of last week.
If Parliament passes the Finance Bill without amendment it may just authorise the beginning of a series of unaccountable transactions involving potentially hundreds of millions of dollars, as the parastatal corporation has already signed contracts with external financiers for massive infrastructural projects.
The name of the parastatal corporation is…the Kenya Airports Authority
The amendments are to be made to the Kenya Airports Authority Act and the Air Passenger Service Charge Act. Subject to the latter every person who purchases a ticket for an external or internal journey must pay a passenger service tax of (20) twenty United States dollars or the equivalent in specified currency or in Kenya shillings for an external journey; and (100) one hundred shillings for an internal journey.
The amendments’ effect is that henceforth rather than paying taxes into the Consolidated Fund from which it can only be withdrawn as per the National Budget or with Parliamentary approval, the Kenya Revenue Authority shall,after deducting its expenses, pay all Air Passenger Service Tax into the newly created Kenya Airports Authority Fund. The amendments do not create an independent board of Trustees of the Fund, and the management of the Fund is left completely to the existing Management of the Kenya Airports Authority.
Under the amended law, the Kenya Airports Authority will be authorised to pay “out of the Fund any expenditure incurred by the Authority in the exercise of its powers or the performance of its functions under this Act.”
Parliament should consider whether it ought to approve these amendments.
Remarks of Barack Obama in the Grand Hall of Cairo University on June 4, 2009
* Obama’s Message to Turkish Students
* Muslims and the "Real America"
* Obama Holds Student Town Hall in Turkey
I am honored to be in the timeless city of Cairo, and to be hosted by two remarkable institutions. For over a thousand years, Al-Azhar has stood as a beacon of Islamic learning, and for over a century, Cairo University has been a source of Egypt's advancement. Together, you represent the harmony between tradition and progress. I am grateful for your hospitality, and the hospitality of the people of Egypt. I am also proud to carry with me the goodwill of the American people, and a greeting of peace from Muslim communities in my country: assalaamu alaykum.
We meet at a time of tension between the United States and Muslims around the world — tension rooted in historical forces that go beyond any current policy debate. The relationship between Islam and the West includes centuries of co-existence and cooperation, but also conflict and religious wars. More recently, tension has been fed by colonialism that denied rights and opportunities to many Muslims, and a Cold War in which Muslim-majority countries were too often treated as proxies without regard to their own aspirations. Moreover, the sweeping change brought by modernity and globalization led many Muslims to view the West as hostile to the traditions of Islam. (See pictures of people around the world watching Obama's inauguration.)
Violent extremists have exploited these tensions in a small but potent minority of Muslims. The attacks of September 11th, 2001 and the continued efforts of these extremists to engage in violence against civilians has led some in my country to view Islam as inevitably hostile not only to America and Western countries, but also to human rights. This has bred more fear and mistrust.
So long as our relationship is defined by our differences, we will empower those who sow hatred rather than peace, and who promote conflict rather than the cooperation that can help all of our people achieve justice and prosperity. This cycle of suspicion and discord must end.
I have come here to seek a new beginning between the United States and Muslims around the world; one based upon mutual interest and mutual respect; and one based upon the truth that America and Islam are not exclusive, and need not be in competition. Instead, they overlap, and share common principles — principles of justice and progress; tolerance and the dignity of all human beings. (See pictures of Obama in the Middle East.)
I do so recognizing that change cannot happen overnight. No single speech can eradicate years of mistrust, nor can I answer in the time that I have all the complex questions that brought us to this point. But I am convinced that in order to move forward, we must say openly the things we hold in our hearts, and that too often are said only behind closed doors. There must be a sustained effort to listen to each other; to learn from each other; to respect one another; and to seek common ground. As the Holy Koran tells us, "Be conscious of God and speak always the truth." That is what I will try to do — to speak the truth as best I can, humbled by the task before us, and firm in my belief that the interests we share as human beings are far more powerful than the forces that drive us apart.
Part of this conviction is rooted in my own experience. I am a Christian, but my father came from a Kenyan family that includes generations of Muslims. As a boy, I spent several years in Indonesia and heard the call of the azaan at the break of dawn and the fall of dusk. As a young man, I worked in Chicago communities where many found dignity and peace in their Muslim faith.
As a student of history, I also know civilization's debt to Islam. It was Islam — at places like Al-Azhar University — that carried the light of learning through so many centuries, paving the way for Europe's Renaissance and Enlightenment. It was innovation in Muslim communities that developed the order of algebra; our magnetic compass and tools of navigation; our mastery of pens and printing; our understanding of how disease spreads and how it can be healed. Islamic culture has given us majestic arches and soaring spires; timeless poetry and cherished music; elegant calligraphy and places of peaceful contemplation. And throughout history, Islam has demonstrated through words and deeds the possibilities of religious tolerance and racial equality.
I know, too, that Islam has always been a part of America's story. The first nation to recognize my country was Morocco. In signing the Treaty of Tripoli in 1796, our second President John Adams wrote, "The United States has in itself no character of enmity against the laws, religion or tranquility of Muslims." And since our founding, American Muslims have enriched the United States. They have fought in our wars, served in government, stood for civil rights, started businesses, taught at our Universities, excelled in our sports arenas, won Nobel Prizes, built our tallest building, and lit the Olympic Torch. And when the first Muslim-American was recently elected to Congress, he took the oath to defend our Constitution using the same Holy Koran that one of our Founding Fathers — Thomas Jefferson — kept in his personal library.
So I have known Islam on three continents before coming to the region where it was first revealed. That experience guides my conviction that partnership between America and Islam must be based on what Islam is, not what it isn't. And I consider it part of my responsibility as President of the United States to fight against negative stereotypes of Islam wherever they appear.
But that same principle must apply to Muslim perceptions of America. Just as Muslims do not fit a crude stereotype, America is not the crude stereotype of a self-interested empire. The United States has been one of the greatest sources of progress that the world has ever known. We were born out of revolution against an empire. We were founded upon the ideal that all are created equal, and we have shed blood and struggled for centuries to give meaning to those words — within our borders, and around the world. We are shaped by every culture, drawn from every end of the Earth, and dedicated to a simple concept: E pluribus unum: "Out of many, one."

However brave and mature ,the move by Martha to step a side from the gvt.is not genuine and is rather based on some egocentric interests she is pursuing.We know that she defended Kibaki on the wrong to gain afterwords but instead got a donkey's kick or at first got a half loaf.And when the negotiations settled on power sharing,she was deliberately eying the premier position which was just an ambition to her.This made the husband less lawyer raise eye brows at Kibaki but her push was in vain and her appeals landed on deaf ears of the master.It is therefore too bitter for her to bear after fighting for this president with all the resources she had at disposal be it propaganda,legal matters and euphoria,name them,the so called disputed Kibaki does his national issues without considering she that made him the hero.Every body else want a share of the national cake and this is what brings about the wrangles in the grand corruption govt.,no I meant the coalition govt but the former makes a good objective adjective.Appointing senior govt leaders and top civil servants without giving karua a chance to fix in her close allies is putting salt on Karua's wounds and no normal person can bear this.
However, the move,were it genuine is a kind that should be adopted by the likes of Ruto, Raila,Anyang' and the rest-if they feel the govt. is not delivering and is rather authoritative let them vacate and let Kenyans give room for those willing to serve them.I wish Karua was going to say "Am paying my taxes from today".
raila follow the foot steps on a genuine ground and the rest shall follow-don't complain too much and yet you are wiling to step aside from the govt. you criticize.

HIGH PERFORMANCE CONCRETE
High performance concrete is defined as concrete which meets special performance and uniformity requirements that cannot always be achieved routinely by using only conventional materials and normal mixing, placing, and curing practices. The requirements may involve enhancements of characteristics such as placement and compaction without segregation, long-term mechanical properties, early-age strength, toughness, volume stability, or service life in severe environments.
Examples of high performance concretes are:
1. High Workability Concrete
The workability of fresh concrete should be suitable for each specific application to ensure that the operations of handling, placing and compaction can be undertaken efficiently.
EN206 : BS8500 the European and UK standards for concretegives guidance on workabilitys for different uses.
The handling and placing properties of concrete mixes can be improved considerably by the use of cement replacement materials such as pulverised fuel ash or ground granulated blast-furnace slag. Further more, the use of admixtures such as water reducers and superplasticisers have beneficial effects on workability without compromising other concrete properties.
On site productivity can be greatly increased by utilising highly workable concretes. They are especially suitable in the following applications:
• inaccessible locations
• large flat areas
• underwater applications
• pumping concrete over long distances
Pumping
Pumping is one of the most popular techniques worldwide to transport fresh concrete. When placing large quantities of fresh concrete, piston pumps are generally used. Concrete is pushed alternately by two pistons acting in cylinders.
2.0 Self Compacting Concrete (SCC)
SCC has been described as "the most revolutionary development in concrete construction for several decades". Originally developed to offset a growing shortage of skilled labour, it has proved beneficial economically because of a number of factors, including:
• faster construction
• reduction in site manpower
• better surface finishes
• easier placing
• improved durability
• greater freedom in design
• thinner concrete sections
• reduced noise levels, absence of vibration
• safer working environment
Originally developed in Japan, SCC technology was made possible by the much earlier development of superplasticisers for concrete. SCC has now been taken up with enthusiasm across Europe, for both site and precast concrete work
3.0 Foamed Concrete
Foamed concrete is a highly workable, low-density material which can incorporate up to 50% entrained air. It is generally self-leveling, self-compacting and may be pumped. Foamed concrete is ideal for filling redundant voids such as disused fuel tanks, sewer systems, pipelines, and culverts - particularly where access is difficult. It is a recognised medium for the reinstatement of temporary road trenches. Good thermal insulation properties make foamed concrete also suitable for sub-screeds and filling under-floor voids.
4.0 High Strength Concrete
The definition of high strength concretes is continually developing. In the 1950s 34N was considered high strength, and in the 1960s compressive strengths of up to 52N were being used commercially. More recently, compressive strengths approaching 138N have been used in cast-in-place buildings.
High-strength concrete columns can hold more weight and therefore be made slimmer than regular strength concrete columns, which allows for more useable space, especially in the lower floors of buildings.
5.0 Lightweight Concrete
Lightweight concretes can either be Lightweight Aggregate concrete, Foamed concrete or Autoclaved Aerated concrete (AAC). Such lightweight concrete blocks are often used in house construction.
Lightweight Aggregate Concrete
Lightweight aggregate concrete can be produced using a variety of lightweight aggregates. Lightweight aggregates originate from either:
Natural materials like volcanic pumice
The thermal treatment of natural raw materials like clay, slate or shale i.e. Leca
Manufacture from industrial by-products such as fly ash, i.e. Lytag
Processing of industrial by-products like FBA or slag
The required properties of the lightweight concrete will have a bearing on the best type of lightweight aggregate to use. If little structural requirement, but high thermal insulation properties are needed, then a light, weak aggregate can be used. This will result in relatively low strength concrete.
Lightweight aggregate concretes can however be used for structural applications, with strengths equivalent to normal weight concrete.
The benefits of using lightweight aggregate concrete include:
• Reduction in dead loads making savings in foundations and reinforcement.
• Improved thermal properties.
• Improved fire resistance.
• Savings in transporting and handling precast units on site.
• Reduction in formwork and propping
6.0 Foamed Concrete
Foamed concrete is a highly workable, low-density material which can incorporate up to 50% entrained air. It is generally self-leveling, self-compacting and may be pumped. Foamed concrete is ideal for filling redundant voids such as disused fuel tanks, sewer systems, pipelines, and culverts - particularly where access is difficult. It is a recognised medium for the reinstatement of temporary road trenches. Good thermal insulation properties make foamed concrete also suitable for sub-screeds and filling under-floor voids.
7.0 No-fines Concrete
No-fines concrete is obtained by eliminating the fine material sand, from the normal concrete mix. The single sized coarse aggregates are surrounded and held together by a thin layer of cement paste giving strength of concrete.
The advantages of this type of concrete are lower density, lower cost due to lower cement content, lower thermal conductivity, relatively low drying shrinkage, no segregation and capillary movement of water, better insulating characteristics than conventional concrete because of the presence of large voids.
8.0 Sprayed Concrete
There are many applications where traditional formwork is not a suitable method of supporting concrete and so sprayed concretes can be used.
These applications include:
• Shell roofs and domes
• Retaining walls
• Piled wall facings
• Silo structures
• Diaphragm walls
• Blast proof structures
• Bank vaults
• Underground Construction
• Tunnel linings
• Free form structures such as those seen in theme parks
• Water Retaining Structures:
• Sea and river walls
• Reservoirs and dams
• Aqueducts
• Swimming pools
Other typical applications include where existing structures require maintenance and repair.
9.0 Water Resistant Concrete
Water resistant concretes are impermeable to water and other fluids either above or below ground. They are high density concretes that incorporate fine particle cement replacements.
10.0 Autoclaved Aerated Concrete (AAC)
AAC was first commercially produced in 1923 in Sweden. Since then, AAC construction systems such as masonry units, reinforced floor/roof and wall panels and lintels have been used on all continents and every climatic condition. AAC can also be sawn by hand, sculpted and penetrated by nails, screws and fixings
11.0 Roller Compacted Concrete
Roller compacted concrete, a durable paving material that carries heavy loads. It is now developing as a fast, economical construction method for dams, off-highway pavement projects, heavy-duty parking and storage areas, and as a base for conventional pavement. It is a stiff, no-slump concrete mixture with the consistency of damp gravel comprised of local aggregates or crushed recycled concrete, portland cement, and water. The mixture is placed and roller compacted with the same commonly available equipment used for asphalt pavement construction. The process requires no forms, finishing, surface texturing, or joint sawing and sealing.

VARSITY SITUATION

KENYATTA UNIVERSITY STRIKE
The emerging protests by the university students in Kenya is a very critical issue that needs more than a debate,blame,condemnation and use of force to quell.If kenya was a feeling nation no more blood could have been shed in the KU strike.Hardly a month when the UoN students took to the streets in opposing the brutal assasination of two human activists and a student in thier own compund-an act of impunity that Ali can not just wash a way.The institutions in Kenya have compromised their roles for other egocentric interests to sellfishly fill the big bellies of the corrupt gvt officials, for example the judiciary has compromised fair trial for extrajudicial killings,the police has compromised law and order for unrest,reckless shooting of innocent citizens and rape to young leadership promising ladies and the legislators have turned the assigned roles of serving the electorates into mannerless stealing of poor citizens property and corruption of the highest standard-where are we headed to?
I know many will be opening their cursed mouths to condemn the students for mischief but little wiil they consider that the students have been oppressed, gagged and mis used by the university administration to an extent that they could nolonger bear.Talking of dialogue is something non existent in the universities of Kenya since any word by the students will always fall on deaf ears of the rulers of the institution.What do they resolve in?-protest.If they can't be heard ,it's rather they be felt, does that sound nice? No it's rather they quench their anger bcoz the accumulation of this is a chronic poison.
I FORESEE A CONTINUETION OF THIS IN OTHER PUBLIC UNIVERSITIES. WATCH OUT!

Smiling_profile_b_w_small I am a physician. I've practiced over 20 years in many states, in rural and urban settings, in the most advanced medical centers and in the most basic country clinics. I've worked in private and corporate practices, in multi-specialty clinics and teaching centers, in government programs, and in urgent and emergency care settings. Never, never have I seen such widespread misery and deteriorating clinical quality, all due to people's inability to pay and poorly organized care. I have patients without insurance coming in daily, having lost... (more)

M1_small Dear President Obama, I am thirty one years old and am in several thousand dollars debt because I was unable to get insurance for several years because of a "pre existing condition". In m early twenties I was diagnosed with malignant melanoma. I was fortunate enough to have caught it early and had a minor surgery to have it removed. I did not have insurance at the time because my full time job did not offer it. I tried to get private insurance but because I have had a history of skin cancer, the only type of insurance I could... Pa_60 I am a pediatrician caring for many children whose families struggle with the current health care system. Yesterday I saw a child whose mom said he wasn't sick, she just wanted to get him checked because her insurance will run out at the end of the month. She is a single parent working hard for an hourly wage, and her job does not provide health benefits. All of her friends are telling her to quit work so she can go on welfare and get free medicaid. This mother takes pride in her work and her ability to provide for her family. She does not... (more)

Ar_60 My daughter who at 20 years old and just started her third year of college was diagnosed with pancreatic cancer. She had to drop out of college for the time as she needed to go through surgery. As soon as she left school she was told that she could no longer be on my insurance policy and her coverage was dropped. This is just when she needed the coverage. She passed away within three years but it was horrible and nobody cared. My view of life and society has forever been changed.

When I had to take a 5% pay cut just after the marriage, I thought I was lucky because I still had a job, and health care that cost me more than $350 a month out of my paycheck. Then, on March 1, I was converted to an independent contractor at less than half pay, and with NO benefits. Just a few weeks ago, I suffered a seizure. And I have no health care. My husband and I lost our jobs and the company my husband was working for fought against him getting unemployment and they won. We are about to lose our home and be on the street. After suffering intense pain and not being able to walk for almost 3 months, I went to the Emergency Room at Helen Ellis Hospital in Tarpon Springs on Feb. 19, 2009. However, I find myself with over $30,000 in outstanding medical bills at this point and I still need expensive tests every 6 months to make sure the cancer is still gone and have to have... (more)

Right now, I believe I pay an insurance premium so that insurance companies can employ marketing consultants, publicists and lobbyists. Ask around the halls of congress. How much money do health "industry" lobbyists and consultants make? Where does the money come from? It's sickening. I've always worked in a small non-profit organization or a small... (more)

UON DEMO N MEDIA
The UoN demo of 10/3/09 was a very peaceful, mature an successful demonstration-a good example to kenyans. However it made us learn and be aware that the kenyan media is all about evil reports.No single media was there to commend how we conducted ourselves maturely in the busy Nairobi CBD without no reportable bad incident-no property touched from the campus to Uhuru park to kenya poly to KICC to vigilance house to Harambee house to the judiciary and finally to central police station after visiting media houses to address our grievances to top govt officials such as Mutua.wako and Hussein Ali.These were never reported by the media but all they could see was the few civilians who took the advantage of the commotion to have some loaves and milk for their hungry stomach-just a coincidental minute incident! shame on citizen and Ntv. Big Kudos to K 24 and Ktn who covered the whole story and made our plea reach a wanjiku or otieno somewhere>Were it not for the tear gases that came from the police later in the day, no stone could have been thrown but bcoz these condemned impunity activists will always agitate peaceful kenyans some bad incidences will always occur.Ali should control his Boys otherwise no peaceful demo wll ever happen in Kenya.Big kudos to agwambo who defended our right of expression!Kenya it is high time you be a feeling nation and the top security organ shold cease to be the top security threat to citizens.
Take a look at the picture above and tell us where exactly we went wrong.If weeping and morning to quench anger is a synonym for looting and stoning motorists!
2.Food shortage catastrophe invading the world:
EVEN THOUGH the world has quite rightly been consumed by the issues on credit markets, an insidious problem is creeping up on us that could affect the world for decades if serious and appropriate measures are not put into use.
There could be ongoing food shortages that go well beyond current concerns on food security, and which will result in regional unrest and conflict as some may put it “ a hungry man is an angry man”. Take for instance the underlying issue of wheat, which shows that world stocks of wheat have been on a downward trend for 4 decades. This trend has continued in the past three years even though we have had two of the largest wheat crops in history during that time. arse grains (corn/maize, sorghum, oats, barley and triticale) and rice over the past 10 years, which means that it covers all of the key grains in the human food supply chain. This is only the surface
The same general trend has occurred in the co problem — we must delve deeper to get a true picture.
The shortage in grain supply and demand has led to significant price rises over the past 18 months. The price of maize for instance doubled in Kenya hardly two months ago. This prompted the government to bar the maize export and instead import maize and sell the same at subsidized prices to the local citizens, which is a big threat to the economic achievement in the country. The big question is “What is wrong with our agricultural practice?” Any Tom, Dick and Harry will rush into pegging the problem on the poor climatic conditions of our land without considering ways in which alternatives can be cropped out to enhance agricultural production. The blame game must therefore be terminated and proper focus made on efficient modern and scientific methods of doing agriculture to curb the crisis. Science, engineering and technology innovations must therefore be welcomed in Agricultural sector to end the problem of unreliable climatic conditions as in the case of agriculturally developed countries such as Britain, Canada, Australia and New Zealand
World population is projected to grow significantly over the next 30-40 years, with the United Nations medium population forecast predicting that world population will be more than 9 billion in 2050, an increase of more than 2.6 billion since 2005.
Despite of the highlighted number of problems but not limited to those, there is light at the end of the tunnel. However, this is no reason for complacency because compared with historical demand, we have a different picture ahead that could fundamentally change the relationship between supply and demand. It is possible that the world agricultural system could cope with this increase through normal productivity improvements, but two other large demand factors are coming into play just as we appear to be approaching limits on arable land and water.
The first of these is that we are seeing exponential growth in world affluence, which means a lot more people will have a lot more money. This sounds great, but it will have a significant effect on food supply because history shows us that as people become more affluent they move from subsistence living on tubers and vegetables, to eating more cereals, and then to eating far more animal protein.
Due to limitations on available land and our depletion of wild fish stocks, any significant increase in animal protein production will have to come from feeding grain and plant protein to animals and fish.
Consequently grain demand will rise even further because it takes a lot more grain to feed an animal than it does for us to survive on the cereals.
The second major new demand factor is the significant push for biofuels in response to climate change and fears of peak oil. As an example, the US ethanol industry alone will use 104 million tonnes of corn next year to produce ethanol. That is 100% of average annual world coarse grain trade and 6.4% of global cereal grain production.
The factors we have described have been discussed by many people, but what will happen has not been fully grasped by anybody. What this means is that demand for cereals is accelerating away from us in a different way — so the global food supply will be significantly different.
Where we differ on our forecasts is that we believe we will be living on the edge of massive food shortages for the foreseeable future. The logic behind this is that we believe global tightness in grain stocks will remain for a long time, albeit it with some volatility.
This means the world will be exposed to the risk of a poor harvest for a large part of the foreseeable future. The way the market is likely to play out is as follows If farmers produce more grain, then the price will fall back in the short term. This in turn will encourage more people to push cereals into biofuels and into animals. At the same time, grain farmers will get reduced price signals so grain production growth will slow. In time this means that global stocks will fall again, prices will rise and the cycle will repeat itself.
In essence, supply and demand will roughly track each other with periodic widening and narrowing of the gap.
This leads us to the main problem. The world food supply chain is a less than perfect market where signals and responses are separated in time due to the biological nature of the system and significant impacts of climatic conditions...
If global supply and demand remain very close over the long term and climate change increases climatic variability, it is highly likely we will get several years in the next 25 years where there will be a catastrophic tightness in world cereal stocks. The tightness in global stocks will be exacerbated by trade restrictions and hoarding by countries with surplus cereals.
3.Energy crisis catastrophe invading the world:
EVEN THOUGH the world has quite rightly been consumed by the issues on credit markets, an insidious problem is creeping up on us that could affect the world for decades if serious and appropriate measures are not put into use. There could be ongoing energy crisis that go well beyond current concerns on food security, and which will result in regional unrest and conflict as energy forms the basis of a country’s economic advancement.
Energy crisis is a situation in which the nation suffers from a disruption of energy supplies (in our case, oil) accompanied by rapidly increasing energy prices that threaten economic and national security. The threat to economic security is represented by the possibility of declining economic growth, increasing inflation, rising unemployment, and losing billions of dollars in investment. The threat to national security is represented by the inability of the government to exercise various foreign policy options, especially in regard to countries with substantial oil reserves. For example, the recent disruption of Venezuelan oil supplies may limit the US policy options toward Iraq.
Kenya, for example, has documented the vision 2030 which without proper concerns on the environmental management and energy conservation will all be in vain. The energy crisis is pegged on the socio-economic variables in the region due to reversed roles of men and women in developing countries. The damage of the environment is a chronic devastating activity on the efforts to conserve the worsening situation of our environment.
A glance at the global energy situation reveals that various measures of US energy security indicate that the US is heading for an energy crisis. Many of the warning signs that existed before the energy crises of 1973 and 1979 exist today and they indicate that the current situation could be even worse. US dependence on petroleum imports has grown steadily for over a decade and has been at record levels for several years. Petroleum inventories are low and the ability of Strategic Petroleum Reserves (SPR) and commercial petroleum stocks to cope with an interruption in imports matches the historic lows preceding the 1973 and 1979 energy crises.
The potential for an energy crisis has never been higher. Oil prices have recently exceeded $80 per barrel and they may continue to increase. The disruption of Venezuelan oil supplies has increased the US dependence on Middle Eastern oil and made the US more susceptible to supply interruption. With the crisis in Venezuela, the capacity of OPEC to meet any additional supply interruption is limited and a war with Iraq would put OPEC at its limit. Any energy crisis in the near future will hinder President Obama’s efforts to improve the economy of the US. An energy crisis could cause a recession, inflation, and higher unemployment as in the case of Kenya where petrol goes for above kshs 70.00 per litre. This has lead to much higher increase in food prices and thus higher living standards.
Looking at the two energy crises of 1973 and 1979, we find some common elements between the two. Both events:
1. Started with political turmoil in some of the oil producing countries. 2. were associated with low oil stocks. 3. were associated with high import concentration from a small number of suppliers. 4. were associated with declining US petroleum production. 5. were associated with high dependency on oil imports. 6. were associated with low level of oil industry spending 7. Led to speculation 8. Caused an economic downturn 9. Limited US policy options in the Middle East
The same indicators and warning signs that existed prior to the energy crises of 1973 and 1979 exist today: a political crisis in Venezuela that halted most of the Venezuelan oil exports, the threat of war with Iraq, stocks at their lowest level in twenty six years, imports nearly record high, more concentrated imports than ever, and low upstream expenditures. However, the current problem is even worse than the previous two energy crises because, unlike the 1970s, we are starting from a case of low economic growth.
The big question that outcrops is,” what can we put in place to curb this chronic problem?” A lot of measures need to be taken by first encouraging the use of renewable sources of energy such as the solar energy and the wind power. Simultaneously energy sources that lead to encroachment and destruction of our environment must be eliminated at all costs and the government must take the lead in homing in on this issue. This is involve the use of chacoal
SONU X-RAY
When asked to give a view of the SONU body most will lay deaf ears to this because the views are obviously not sweet to the ears, “Why” is not a question in this issue but the truth of the matter is that the University of Nairobi doesn’t have a student body or if it has then something is missing some where. Or should I say imperfections and flaws are rampant in it.
Now that the sonu politics is dawning and every willing aspirant is gathering slogans, quotes, crummed speeches, philosophical statements,… name them from books and well off speakers like Obama, Lumumba- just to mention the few and not limited to those. Along side these they have to solicit for finance from their relatives, Mps and sponsors for those who are lucky enough-the likes of those who were born on Sunday. With these, they shall have armed themselves enough to attack the very SONU and put it on the wrong promising to positively “change it” when they get to power. These are the times they confer with the other comrades that for real SONU is dead and that they are going to raise it-Oh NO our esteemed chosen few, You cant be God or do you people want to be small gods in the world ?If yes dial 666.
The worrying quiz will be then why do “our” sonu leaders fail to lead and instead mislead and turn into shameless thieves- robbing from their fellow comrades with impunity in broad day light in the name of representing the university students just because they want to raise their economic power and enhance their political influence so as to gain favor in days to come in the national matters where avenues for amassing wealth shall be how much is your influence and how well can you play your ball given the court and time under standard temperature and pressure. Another comrade Samuel Otieno in Kabete pesa describe them as “These SONU officials are just shameless conmen trotting the globe in mere teenage excitement!!” he adds by a quiz “Do SONU people think they can hoodwink us, or bambozal us.....we are not gonna let them play the ok dokey on us”. God condemn, No am sorry I wanted to say God have mercy, No, God forbid! Did you get the quiz?
The answer is very simple: the fact that sonu has become a political forum and not a student organization is the most triggering mechanism to this condemned unethical act. It has become a give and take kind of business where aspirant confuse fellow comrades with Muratz,chang’aa and few notes of bribery in the name of ‘goonship’ fee-these monies they have to recover within the eleven months of their presence in the offices of “duties” not to consider how well they are, in terms of free accommodation and monthly appreciation of their unworthy service in form of cash. But how do they effect this?
It takes them nothing but to guess and come up with white elephant projects in the name of considering the welfare of students and to hire excellent proposal writers in the vicinity-some even pay for a course on proposal writing to ensure success in their selfish request. The monument of this is always a good package, and they have decided to brand it a name JACK POT-a term used to denote the big cash they receive as reward to their good for nothing projects-Just to ask what have the soon outgoing sonu officials achieved worth classifying in nation building and economy improvement? The obvious un debatable genuine answer is NOTHING and this is the reason we call them officials and not leaders.In order for them to amass more they collude with the administration, for instance after a good talk, they decided to add more tax on the students by increasing the student union fee- an act that created a lot of confusion during the start of this 08/09 academic year. Sorry if am over judging them but the cat must be let out of the basket for a better tomorrow. What can we do now?
As many will confer with me, the campaign rallies are one thing that must be stooped at all cost. These are the areas they get the podia to infiltrate the ears of our democracy loving comrades with propaganda in the name of gaining fame and searching for votes. Out of this confusion following their perfectly memorized speeches, fellow students are lured to vote on the basis of where an aspirant is originating and how well he/ she has funded his/her campaigns. So long as comrades will still be swayed to vote by their stomach and not their heads, then these hyenas in sheep wool will still continue misleading them. Others even are too disillusioned to vote on how beautiful or handsome an aspirant is appearing in the poster-very absurd!In this era an university should not be a place to train shameless robbers at the expense of practicing politics.A better way of having the leaders in the student union should be invented. Or if possible do away with the sonu thing-after all it is not for students.
Faculty associations should therefore be given more mandate and better funds allocated to them since as at now they seem to be reflecting what a student would wish an association to offer for him/ her. The saddening thing is that even the faculty associations are also influenced in one way or the other by the so called sonu.
FELLOW ENGINEERING COMRADES it takes more than a hand to harvest the honey-kidole kimoja hakivunji chawa. Lets join hands in good spirits to build ESA together as it has always been a good avenue for more knowledge and adventure. ACES is another gainful association for civil engineering students. i.e Association of Civil Engineering Students. Lets sign up!However, watch out as the sonu politics descend and let your sober mind advise you on what to do.I having been involved in the sonu politics I have come to know the several flaws in it and I promised myself that unless comrades change their mind and start reasoning as change initiators then I would let sonu be thrown to the dogs.And if the system cant change, then our beloved Nation will still be regarded as a place where it is a crime to be good!Change is no change when the mindset is not changed-mark my words!

a thousand masks,
masks that I'm afraid to take off,
and none of them is me.
Pretending is an art that's second nature with me,
but don't be fooled, for God's sake don't be fooled.
I give you the impression that I'm secure,
that all is sunny and unruffled with me,
within as well as without,
that confidence is my name and coolness my game,
that the water's calm and I'm in command and that I need no one,
but don't believe me.
My surface may seem smooth but my surface is my mask,
ever-varying and ever-concealing.
Beneath lies no complacence.
Beneath lies confusion, and fear, and aloneness.
But I hide this.
I don't want anybody to know it.
I panic at the thought of my weakness exposed.
That's why I frantically create a mask to hide behind,
a nonchalant sophisticated facade,
to help me pretend,
to shield me from the glance that knows.
But such a glance is precisely my salvation,
my only hope, and I know it.
That is, if it's followed by acceptance,
if it's followed by love.
It's the only thing that can liberate me from myself,
from my own self-built prison walls,
from the barriers I so painstakingly erect.
It's the only thing that will assure me of what I can't assure myself,
that I'm really worth something.
But I don't tell you this.
I don't dare to, I'm afraid to.
I'm afraid your glance will not be followed by acceptance,
will not be followed by love.
I'm afraid you'll think less of me,
that you'll laugh, and your laugh would kill me.
I'm afraid that deep-down I'm nothing
and that you will see this and reject me.
So I play my game, my desperate pretending game,
with a facade of assurance without and a trembling child within.
So begins the glittering but empty parade of masks,
and my life becomes a front.
I tell you everything that's really nothing,
and nothing of what's everything,
of what's crying within me.
So when I'm going through my routine
do not be fooled by what I'm saying.
Please listen carefully and try to hear what I'm not saying,
what I'd like to be able to say,
what for survival I need to say,
but what I can't say.
I don't like hiding.
I don't like playing superficial phony games.
I want to stop playing them.
I want to be genuine and spontaneous and me
but you've got to help me.
You've got to hold out your hand
even when that's the last thing I seem to want.
Only you can wipe away from my eyes
the blank stare of the breathing dead.
Only you can call me into aliveness.
Each time you're kind, and gentle, and encouraging,
each time you try to understand because you really care,
my heart begins to grow wings--
very small wings,
very feeble wings,
but wings!
With your power to touch me into feeling
you can breathe life into me.
I want you to know that.
I want you to know how important you are to me,
how you can be a creator--an honest-to-God creator--
of the person that is me if you choose to.
You alone can break down the wall behind which I tremble,
you alone can remove my mask,
you alone can release me from my shadow-world of panic,
from my lonely prison,
if you choose to.
Please choose to.
Do not pass me by.
It will not be easy for you.
A long conviction of worthlessness builds strong walls.
The nearer you approach to me the blinder I may strike back.
It's irrational, but despite what the books say about man
often I am irrational.
I fight against the very thing I cry out for.
But I am told that love is stronger than strong walls
and in this lies my hope.
Please try to beat down those walls
with firm hands but with gentle hands
for a child is very sensitive.
Who am I, you may wonder?
I am someone you know very well.
For I am every man you meet
and I am every woman you meet.
And I am Paul
And that's what I desire to be
MY FATE
Don’t know the time and the date
When no one will be my mate
Solely I’ll face my fate
At the time of the last sentence
Nothing to hide even into the metallic fence
When my sense will be no sense
And the fate that nobody knows
Doubting Thomases still rampant
Not knowing prophecy is invariant
No wealth will be of any value
For them no rule shall be bent
I’m not an angel or any God sent
I’m just a mere messenger of little value
And I don’t require any pay not even a cent
Listen ye inhabitants of the world
None shall exchange the fate for gold
For He will come and speak in bold
The sentence that shall send the sheep to the right
And leave the goats on the left
No more trial in this last court
O my fate let me see you in a dream
I fear it because I can’t predict it
Neither do the angels know it
The God of men secretly keeps it
Am ready but again no yet
I want to better it-it’s a bet
And why are my ways in vain
Like an island of ignorance I’ll never remain.
BLISS
I see her perform some cancan
Her twirling and whirling excites
After an ogle at her
She comes and cuddles me
I freak and make her be the family way
And our conjugal marriage becomes consummated
Always in triumphs
When the joyous anticipation comes true
When the first bouncing bay boy begets
Winning a commendation from the elders
For every mouth is fed to the brim
A connoisseur could have done it better
Fro her beauty is dangerous and intimidating
A true compliment to me
And the society that benefit from her clean heart
Showering in blessings and happiness
Diviners have stories for this connubial
